1. Acceptance of Terms
By downloading, installing, or using the GeoProCam mobile application („the App”), you agree to be bound by these Terms of Use („Terms”). The App is owned and operated by Kidologic Ltd („we”, „us”, or „our”). If you do not agree to these Terms, do not use the App.
2. Description of Service
GeoProCam is a professional mobile application designed for engineering, surveying, and field-inspection tasks. It allows users to capture photos with embedded GPS coordinates, import/export geographic data (e.g., KML, GeoJSON, Excel), and log field data.
Local-First Architecture: The App is designed to store data primarily on your local device and, optionally, synchronize with your personal third-party cloud storage accounts (Google Drive or Microsoft OneDrive). We do not host your projects on our servers.
3. User Responsibilities and Data Loss
Because GeoProCam operates on a local-first basis and utilizes your personal cloud storage:
- Data Backup: You are solely responsible for maintaining backups of your project data, photos, and files. Kidologic Ltd is not responsible or liable for any lost, corrupted, or deleted data resulting from device failure, accidental deletion, App uninstallation, or cloud synchronization errors.
- Account Security: You are responsible for safeguarding the login credentials of your linked Google or Microsoft accounts.
4. Accuracy of Data
GeoProCam relies on your device’s hardware (GPS, compass) and third-party APIs (Open-Meteo) to capture location, elevation, azimuth, and weather data.
- No Guarantee of Precision: We do not guarantee the absolute accuracy, completeness, or reliability of any geographic, positional, or weather data recorded by the App.
- Professional Verification: The App is a tool to assist professionals but should not replace high-precision surveying equipment or professional judgment. You use the data generated by the App strictly at your own risk.
5. Subscriptions and Purchases
Certain features of the App may be available only through premium subscriptions or in-app purchases.
- Payments will be charged to your Apple App Store or Google Play account at confirmation of purchase.
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- You can manage your subscriptions and turn off auto-renewal by going to your App Store or Play Store Account Settings after purchase.
6. Third-Party Services
The App integrates with third-party services, including Google Maps, Google Drive, Microsoft OneDrive, and Open-Meteo. Your use of these services is subject to their respective Terms of Service and Privacy Policies. Kidologic Ltd is not responsible for the availability, functionality, or policies of these third-party providers.
7. Intellectual Property
All content, design, code, graphics, and interfaces within the App are the intellectual property of Kidologic Ltd or our licensors. You may not copy, modify, distribute, sell, or lease any part of our App or included software without our written permission.
8. Disclaimer of Warranties
THE APP IS PROVIDED „AS IS” AND „AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, KIDOLOGIC LTD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
9. Limitation of Liability
IN NO EVENT SHALL KIDOLOGIC LTD, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF, OR INABILITY TO USE, THE APP, INCLUDING BUT NOT LIMITED TO FINANCIAL LOSSES, PROJECT DELAYS, OR LOSS OF DATA.
10. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms of Use within the App or on our website. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
